Jack Hulland Elementary

OVERVIEW

A class action lawsuit has been filed in the Yukon against the Government of Yukon, the Department of Education and the Jack Hulland Elementary School Council of Attendance Area #22.

This action arises from the systemic use of holds, restraints and involuntary seclusion to control students’ behavior at Jack Hulland Elementary School (“Jack Hulland”) beginning in, or about, September, 2002 and to about June, 2022.

Class Members

You are a Class Member of the continuing class action against the Government of Yukon if you were a student of Jack Hulland between January 1, 2007 and June 30, 2022, and you were subjected to a hold, restraint, locked in a room, and/or placed in seclusion.

You are a Settlement Class Member of the settled class action against the Jack Hulland Elementary School Council of Area #22 if you were a student of Jack Hulland between January 1, 2002 and June 30, 2022, and you were subjected to a hold, restraint, locked in a room, and/or placed in seclusion.

Settlement with Jack Hulland School Council

On May 17, 2023, the class action was settled against the Jack Hulland Elementary School Council of Area #22 in exchange for the council providing the plaintiffs with cooperation in the nature of documents and information. Settlement Class Members are barred from bringing related claims against the Jack Hulland Elementary School Council of Area #22.

Certification against the Government of Yukon

The lawsuit is continuing against the Yukon Government.

On June 26-28, 2023, Class Counsel appeared before the Court to seek certification of this action against the Government of Yukon.

On September 6, 2023, the Court granted the Plaintiffs’ request to certify the action against the Government of Yukon.

Opt-out Deadline: August 23, 2024

If you do not wish to participate in in the class action and the settlement with the School Council please provide a completed copy of the Opt-Out Form to Class Counsel by email no later than midnight on August 23, 2024 or by mail postmarked on or before August 23, 2024 to CFM Lawyers or Tucker Carruthers.
